Overview

These Terms of Service (the “Terms”) govern your access to and use of My envelopes (the “App”) and any related websites, products, and services (collectively, the “Services”) provided by Vinicius Lara, an individual developer (“we,” “us,” or “our”). By accessing or using the Services, you agree to these Terms.

If you do not agree to these Terms, do not use the Services.

Eligibility

You must be at least 13 years old to use the Services. If you are under the age of majority where you live, you may use the Services only with the consent of a parent or legal guardian.

If you use the Services on behalf of an organization, you represent and warrant that you have authority to bind that organization to these Terms, and “you” includes that organization.

Accounts and Security

You may need an account to use certain features. You agree to provide accurate information, keep it up to date, maintain the confidentiality of your credentials, and notify us promptly of any unauthorized access or use of your account.

You are responsible for all activities under your account.

Using the Services

Subject to these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to access and use the Services for your personal or internal business use.

We may add, remove, or modify features at any time.

Acceptable Use

You agree not to, and not to assist others to:

  • violate any law or regulation;
  • infringe or violate others’ rights (including intellectual property, privacy, or publicity rights);
  • access, tamper with, or use non-public areas of the Services or our systems;
  • probe, scan, or test the vulnerability of any system or network, or bypass security measures;
  • interfere with or disrupt the Services (including by introducing malware, spamming, scraping at harmful rates, or abusing APIs);
  • reverse engineer or attempt to extract source code from the Services, except where such restriction is prohibited by law;
  • use the Services to develop or train competing products where prohibited by applicable law or contract; or
  • misrepresent your identity or affiliation.

We may suspend or terminate your access if we believe you have violated these Terms.

User Content

“User Content” means content you submit, upload, transmit, or otherwise make available through the Services (for example: text, images, files, and links).

Your responsibilities

You are responsible for your User Content. You represent and warrant that you have all rights necessary to provide your User Content and to grant the rights in these Terms, and that your User Content (and our use of it as permitted by these Terms) will not violate any law or infringe any rights of any third party.

License to us

You grant us a worldwide, non-exclusive, royalty-free, sublicensable, and transferable license to host, store, reproduce, modify, create derivative works from (for technical operation, formatting, and display), communicate, publish, publicly perform, publicly display, and distribute your User Content solely to operate, provide, maintain, and improve the Services.

Removal

We may remove or restrict access to User Content if we reasonably believe it violates these Terms or the law.

Intellectual Property

The Services, including software, text, graphics, logos, and other materials, are owned by or licensed to us and are protected by intellectual property laws. Except for the limited license granted in these Terms, we reserve all rights in and to the Services.

If you provide feedback or suggestions, you grant us the right to use them without restriction or compensation.

Third-Party Services and Links

The Services may integrate with or link to third-party services, content, or websites. We do not control and are not responsible for third-party services. Your use of third-party services is governed by their terms and policies.

Paid Features

The Services may include subscriptions, in-app purchases, or other paid features (“Paid Features”).

Paid plans may include Standard Support or Priority Support. Standard Support does not include a service level agreement (SLA) or a guaranteed response time. Priority Support includes a target first response within 24 hours on business days.

Billing

All Paid Features are purchased through the Apple App Store. Apple processes your payment, and your purchase may be subject to Apple’s terms and policies.

Refund requests, cancellations, and subscription management are handled by Apple (for example, through your Apple ID subscription settings) and are subject to Apple’s policies. We do not control Apple’s billing systems and we do not have access to your full payment information.

Trials and promotions

If we offer a free trial or promotional pricing, the terms will be disclosed at signup. Unless canceled before the trial ends, your subscription will convert to a paid subscription and you will be charged at the then-current rate.

Price changes

We may change prices from time to time. If required by law, we will provide advance notice. Price changes apply going forward and do not affect previously incurred charges.

Privacy

Our collection and use of personal information is described in our Privacy Policy.

Beta Features

If we provide beta, preview, or experimental features, they may be unstable, may change or be discontinued, and are provided “as is” without any warranties to the fullest extent permitted by law.

Termination

You may stop using the Services at any time. We may suspend or terminate your access to the Services, with or without notice, if we reasonably believe you have violated these Terms, pose a risk to the Services or other users, or if required by law.

Sections that by their nature should survive termination will survive (including: User Content licenses, Intellectual property, Disclaimers, Limitation of liability, Indemnity, and Dispute resolution).

Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

The Services may provide information for general purposes only and are not professional advice. You are responsible for how you use any outputs, recommendations, or information.

Limitation of Liability

TO THE FULLEST EXTENT PERMITTED BY LAW, WE (AND, TO THE EXTENT APPLICABLE, OUR AFFILIATES, OFFICERS, EMPLOYEES, AGENTS, PARTNERS, AND LICENSORS) WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO YOUR USE OF (OR INABILITY TO USE) THE SERVICES.

TO THE FULLEST EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO US FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM, OR US $100, WHICHEVER IS GREATER.

Some jurisdictions do not allow certain limitations of liability, so some of the above may not apply to you.

Indemnity

You will indemnify, defend, and hold harmless us (and, to the extent applicable, our affiliates, officers, employees, and agents) from and against any claims, liabilities, damages, losses, and expenses (including reasonable attorneys’ fees) arising out of or related to: (a) your use of the Services; (b) your User Content; or (c) your violation of these Terms or applicable law.

Dispute Resolution and Governing Law

These Terms are governed by the laws of the Commonwealth of Massachusetts and applicable U.S. federal law, excluding conflict of laws rules.

Before filing a claim, you agree to contact us at support@myenvelopes.app and attempt to resolve the dispute informally for at least 30 days.

Any legal action arising out of or relating to these Terms or the Services must be brought exclusively in the state or federal courts located in Massachusetts, and you consent to their jurisdiction and venue.

Changes to These Terms

We may update these Terms from time to time. If we make material changes, we will provide reasonable notice (for example, by posting the updated Terms in the App or on our website, or by email). Your continued use of the Services after the effective date of the updated Terms constitutes acceptance.
